Welcome to myClerkBook. These Terms and Conditions ("Terms") govern your access to and use of the myClerkBook waitlist website and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Effective Date: December 2024

This website is a pre-launch waitlist and information page for myClerkBook, an upcoming AI-powered income and expense management platform. Currently, the Service provides:

• Waitlist Registration: Join the waitlist to be notified when myClerkBook launches
• Feedback Submission: Share suggestions, questions, or bug reports with our team
• Support Contributions: Support the development of myClerkBook through voluntary payments via PayPal
• Information: Learn about the planned features and roadmap for myClerkBook

Important: The full myClerkBook application is not yet available. This is a waitlist website only. When launched, myClerkBook will not connect to your bank accounts and will require manual data entry. We are not a financial advisor and do not provide financial, tax, or legal advice.

The current Service does not require account creation. To join the waitlist or submit feedback, you only need to provide your email address. You agree to:

• Provide a valid email address that you have access to
• Not use someone else's email address without permission
• Not submit spam or automated registrations
• Accept that joining the waitlist does not guarantee access to the future application

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this age requirement.

As a user of this website, you are responsible for:

• Providing accurate information when joining the waitlist or submitting feedback
• Complying with all applicable laws and regulations
• Using the Service only for lawful purposes
• Not submitting spam, fraudulent, or abusive content
• Respecting the intellectual property rights of myClerkBook
• Not attempting to gain unauthorized access to the Service or its systems

Support contributions are voluntary and non-refundable. By making a support payment, you acknowledge that you are supporting the development of myClerkBook and not purchasing a product or service.

The waitlist website is free to use. You may optionally support the development of myClerkBook through voluntary contributions:

• Supporter Tier: $5 - $25 (Beta access, direct feedback channel)
• Supporter+ Tier: $25 - $100 (25% off for 3 months, beta access, direct feedback channel)
• Founder Tier: $100+ (50% off for 6 months, beta access, direct team communication)

Payment Terms:

• All payments are processed securely through PayPal
• Support contributions are voluntary and non-refundable
• Contributions do not guarantee access to the future application
• Tier benefits will be honored when myClerkBook launches
• We reserve the right to modify tier benefits with notice

Important: Support contributions are donations to help fund development. They are not purchases of products or services. If myClerkBook does not launch, no refunds will be provided.

Our Rights: The Service, including all content, features, and functionality, is owned by myClerkBook and is protected by copyright, trademark, and other intellectual property laws.

Your Rights: You retain all rights to the financial data and content you enter or upload to the Service. By using the Service, you grant us a limited license to use, store, and process your data solely for the purpose of providing the Service to you.

Restrictions: You may not:

• Copy, modify, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble the Service
• Remove or alter any copyright, trademark, or proprietary notices
• Use the Service to develop competing products or services

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Upload viruses, malware, or other malicious code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without permission
• Impersonate any person or entity or misrepresent your affiliation
• Collect or harvest information about other users
• Use the Service to send spam or unsolicited communications

By You: You may request removal from the waitlist at any time by contacting us at miiso@myclerkbook.com.

By Us: We may remove you from the waitlist or block your access to the website if:

• You violate these Terms
• You submit spam or abusive content
• Your use of the Service poses a security or legal risk
• We discontinue the waitlist or project (with notice)

Effect of Removal: Upon removal, you will no longer receive updates about myClerkBook. Your data will be retained according to our Privacy Policy unless you request deletion.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding the accuracy, reliability, or completeness of information on the website
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties that myClerkBook will launch or be available in the future
• Warranties regarding the features, pricing, or functionality of the future myClerkBook application

We reserve the right to modify, delay, or cancel the development of myClerkBook at any time without liability. Support contributions are non-refundable even if the project does not launch.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYCLERKBOOK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

This includes damages arising from:

• Your use or inability to use the Service
• Any errors, inaccuracies, or omissions on the website
• Unauthorized access to or use of your email address
• Delay or cancellation of the myClerkBook project
• Changes to planned features, pricing, or functionality
• Loss of support contributions if the project does not launch

Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us as support contributions, or $100, whichever is less.

You agree to indemnify, defend, and hold harmless myClerkBook, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content or data you submit, post, or transmit through the Service

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which myClerkBook operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court to protect intellectual property rights.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Effective Date" at the top of these Terms
• Sending you an email notification for significant changes

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
